论地方立法“结合实际”条款的规范展开

On the Normative Expansion of“Combining with Reality”Clause in Local Legislation

地方性法规的治理意义和价值体现在其具有地方特色,在具体的制度设计上,可以依据地方治理的问题导向,作出具有可操作性的规范设计。在地方性法规立法原则的规定中,除了地方性法规制定的目的性表述和法律根据表述外,绝大多数都有“结合本省实际”或“结合本地区实际”的表述,这一立法语言的表达,不仅为地方性法规提供了立法的正当性依据,也提供了作出相较于上位法更为具体制度设计的依据,在一定程度上呼应了地方性法规在一定行政区划内有效的效力规定。本文针对“结合本省实际”条款所折射立法现状,以“结合实际”实际条款为指导,提出规范立法表达、明确立法体例与内容、构建协调的立法体系三条路径,以期从制度层面贴合本地治理实际,提高我国地方性法规解决地方治理中实际问题的能力。

The governance significance and value of local laws and regulations are reflected in their local characteristics.In the specific system design,it is possible to make an operational standard design according to the problem orientation of local governance.In the provisions of the legislative principle of local regulations,in addition to the expression of the purpose of the formulation of local regulations and the expression of the legal basis,most of them include expressions such as“combining with the reality of the province”or“combining with the reality of the region”.The legislative language not only provides a legitimate basis for legitimacy of local regulations but also allows for more specific system design compared to upper law.It also echoes the effective provisions of local regulations in a certain administrative division to a certain extent.In view of the legislative status reflected in the“combined with reality”clause,this paper puts forward three ways to standardize the legislative expression,clarify the legislative style and content,and build a coordinated legislative system,so as to fit the local governance reality from the system level and improve the ability of local regulations to solve the practical problems in local governance.
