生态整体论视域下生态保护地方立法的完善进路--基于黄河流域地方立法实践的考察

The Improvement of Local Legislation for Ecological Protection in the Ecological Holistic Perspective--Based on the Investigation of Local Legislative Practices in the Yellow River Basin

黄河流域是我国重要的生态屏障,但生态相对脆弱,是20世纪50年代后受环境污染比较严重的区域。运用法治手段推动协同保护,从而强化各方责任来加强黄河流域生态保护。地方立法是黄河流域生态保护法治保障体系的重要组成部分。沿黄各省市的地方立法存在缺乏整体性思维、法规规章类较少、立法积极性程度不一、未及时回应生态问题、创新性和可操作性不足等问题,亟须从生态整体论出发,积极探索建立生态保护协同立法制度,在实质内容和形式技术上加以优化,推动实现人与自然的和谐共生。

The Yellow River Basin,an important ecological barrier in China,has long been a key area of ecological fragility and environmental pollution.In order to strengthen the ecological protection of the Yellow River Basin,it is necessary to use the rule of law to enhance collaborative governance and strengthen the responsibilities of all parties.Local legislation is an important part of the legal guarantee system for ecological protection in the Yellow River Basin.However,there are several challenges in the local legislation of provinces and cities along the Yellow River.These challenges include a lack of comprehensive management thinking,limited rules and regulations,varying legislative initiatives,delayed response to problems,and insufficient innovation and maneuverability.Starting from the integrity of the ecosystem,it is urgent to actively explore the establishment of an ecological collaborative legislative mechanism,and optimize the legislative substance and legislative form and technology in order to further promote harmonious coexistence between man and nature.
