互联网的时代浪潮已经渗透到了法律运行的每个环节,很大程度上改变了传统法律职业者的工作方式,也为法律职业规范与伦理带来了许多新挑战。互联网时代背景下,网络舆论裹挟司法对独立规范造成了破坏,保密规范面临着更大的困境,司法责任伦理受到了冲击,法律职业形象维护难度进一步加大,互联网技术为律师违规接受委托提供了便利。面对这些问题,我们应当优化舆情监测体系,推进司法系统保密技术培训、强化律师职业伦理规范教育,进一步培养司法人员责任感,构建合理的司法责任制度体系,完善司法机关舆情响应机制,健全律师违规行为监管制度。

The tide of Internet has infiltrated into every link of law operation,which has changed the traditional way of work of legal professionals to a great extent,and has brought many new challenges to the norms and ethics of legal profession.Under the background of the Internet era,the Internet public opinion has destroyed the independent norms,the secrecy norms are facing greater difficulties,the ethics of judicial responsibility has been impacted,and the maintenance of the legal professional image has further increased,internet technology has made it easier for lawyers to accept commissions illegally.In the face of these problems,we should optimize the public opinion monitoring system,promote the training of the judicial system in secrecy techniques,strengthen the education of professional ethics for lawyers,and further cultivate the sense of responsibility of judicial personnel,we should establish a reasonable system of judicial responsibility,improve the mechanism for responding to public judiciary,and improve the system for monitoring lawyers’misconduct.
