摘要
行政首长出庭应诉制度以“实质性化解行政争议”及“缓解行政首长出庭应诉压力”为价值目标。但经后续修改,“实质性化解行政争议”这一价值目标不仅在内容架构中难以体现、在制度发展趋势与价值实现路径间产生割裂,且因自身的模糊性、开放性,导致“实质性化解行政争议”这一价值目标名不副实。因此,应通过善用人民法院书面建议权及限缩行政机关任意指派人员出庭应诉的方式构建行政首长应诉制度,以落实“实质性化解行政争议”的要求。
The system of administrative heads responding to lawsuits in court takes“substantively resolving administrative disputes”and“easing the pressure of administrative heads responding to lawsuits in court”as its value goals.However,after subsequent modification,the value goal of“substantive resolution of administrative disputes”is not only difficult to reflect in the content structure,but also creates a gap between the development trend of the system and the path of realising the value,and because of its own ambiguity and openness,the value objective of“substantively resolving of administrative disputes”fails to live up to its name.Therefore,The administrative head response system should be constructed by making good use of the people’s court’s right to make written recommendations and by limiting the arbitrary appointment of administrative organs to respond to the lawsuit in court in order to implement the requirement of“substantive resolution of administrative disputes”.
