摘要
我国绝大部分监狱刑罚变更执行中有关数据的采集、记录、公示仍停留在人工化和书面化时代。在该机制下,存储和公布刑罚变更数据的过程中经常出现准确性差、时效性不强、连续性弱等问题,导致执法监督不便。为此,本文将区块链中的共识机制、智能合约、链上链下可信的交互存储机制、跨链等技术融入监狱的执法监督,实现监狱执法数据存储的完整性、不可篡改性、不可删除性以及智能化的多方监督,以解决监狱在执法监督方面出现的各类问题,进而建立并完善“事前引导”“事中防范”“事后监管”的新型执法监督体系。
The collection,recording,and disclosure of relevant data in the execution of the vast majority of prison penalty changes in China still remain in the era of artificial and written forms.Under this mechanism,problems such as poor accuracy,weak timeliness,and weak continuity often occur during the storage and publication of penalty change data,leading to inconvenience in law enforcement supervision.Therefore,this paper integrates consensus mechanisms,smart contracts,trusted interactive storage mechanisms on and off the chain,and cross chain technologies in blockchain into prison law enforcement supervision,achieving the integrity,immutability,indelibility,and intelligent multi-party supervision of prison law enforcement data storage,in order to solve various problems in prison law enforcement supervision,furthermore,establish and improve a new system of law enforcement supervision that includes"pre guidance""prevention during the process""post supervision".
