微商网售自制食品的法律规制研究

Research on the Legal Regulation of Homemade Food Sold Online by Micro-business

对微商网售自制食品的法律适用现状及其特点进行概述,并就此分析网售自制食品相关的法律规制问题,即法律规制不明晰、网售自制食品安全监管难落实、自制食品质量无法保证、交易双方的权益均无法得到有效保障。为解决上述问题,提出了完善微商网售自制食品的法律规制体系的建议,即在完善微商网售自制食品立法供给的前提下,社交平台承担一定监督责任并与当地执法机关配合管理,提升公众的警惕性和维权积极性,以此规制微商网售自制食品。

This paper overviews the current status of the legal application of homemade food sold online by micro-busi-ness and its characteristics,and analyzes the legal regulation problems related to the online sale of homemade food,such as unclear legal regulation,difficult to implement the safety supervision for the online selling homemade food,dif-ficult to guarantee the quality of the homemade food,and difficult to effectively safeguard the rights and interests of both parties to the transaction.To solve the above problems,this paper puts forward suggestions to improve the legal regulation system of homemade food sold online by micro-business,that is,under the premise of improving the legisla-tion supply for homemade food sold online by micro-business,social platforms undertake certain supervision responsi-bility and cooperate with local law enforcement agencies in their management,and meanwhile,enhance the public’s vigilance and the enthusiasm for rights protection,to regulate the online sales of homemade food by micro-business.
