Enlightenment on Extraterritorial Development Trend of Filter Obligation to the Copyright Legislation

【目的】聚焦NFT体系中的数字藏品问题,试图厘清数字藏品的本质并探究其能否成为我国著作权法意义上的作品。【方法】本文主要运用文献研究法和比较研究法,通过对NFT与数字藏品概念的分别阐述与对比来明确二者的关系。【结果】经研究认为数字藏品本身不适合成为作品并受到保护,但其映射的现实作品的数字化过程及最终表现形式,或直接运用数字技术构成的虚拟作品,具有成为作品并受到保护的可能。【结论】区分数字藏品与数字作品对保护消费者权益、司法实践等具有现实意义。

[Purposes]This paper aims to analyze the legislative logic behind the DSM Directive,and bring enlightenment to the introduction of filtering obligations in China's future copyright legislation.[Methods]Taking the copyright filtering obligation of network service providers as the research object,this paper sorts out the international trend of its rule changes,then analyzes and summarizes the problems existing in the DSM Directive from the perspective of comparative law.[Findings]While the DSM Directive has made a groundbreaking breakthrough to the safe harbor rules,the internal problems in its legislative framework and the unexpected legal efficacy should not be ignored.[Conclusions]With attention paid to the relationships between legislation and technology,the legislators should change legislative ideas in future,including correcting the misunderstanding of the nature of filtering obligations and balancing the interests among all parties.Meanwhile,a differentiated response mechanism for filtering and improvements in the post-relief remedy is necessary to refine the related rules.
