关于深化进出口商品法定检验制度改革的思考

Thoughts on deepening the reform of the legal inspection system of import and export commodities

进出口商品法定检验制度在一定的历史时期对我国进出口产品质量提升做出来过巨大贡献,为对外贸易的顺利发展奠定了基础。但在我国全面深化改革和世界贸易自由化发展的时代背景之下,新海关全面承担起检验检疫职能,需要顺应国际通行规则,在世界贸易组织技术贸易壁垒框架之下,调整进出口商品法定检验制度。本文通过剖析进出口商品法定检验制度的法律地位及职责定位,从立法研究、制度建设、风险防控、后续监管及联合监管等方面提出意见建议,为深化进出口商品法定检验制度改革提供参考。

The statutory inspection system for import and export commodities has made great contribution to the improvement of the quality of import and export products in a certain historical period,and laid a foundation for the smooth development of foreign trade.However,in the background of Deepening Reform Comprehensively and the development of the free trade,the new customs fully assumes the inspection and quarantine functions,and it is necessary to conform to the international prevailing rules and adjust the statutory inspection system for import and export commodities under the framework of WTO issues in the technical barriers to trade.By analyzing the legal status and duty orientation of the statutory inspection system for import and export commodities,this paper puts forward suggestions from the aspects of legislative research,system construction,risk prevention and control,follow-up supervision and Co-supervision,it provides reference for deepening the reform of legal inspection system of import and export commodities.
