乡村振兴视域下法治乡村建设的实践进路——基于江苏武进湟里镇西墅村及周边村的调研

乡村振兴战略下的法治乡村建设非常重要,在国家战略部署和顶层设计文件中被持续提及,乡村的法治建设成为国家治理体系的重要组成部分,成为中国式法治现代化的重要表现形式。法治乡村建设实践进路具有其必要性和可行性。“湟里西墅法治乡村模式”是乡村振兴视域下法治乡村建设的典型实践进路,这种典型性是通过制度逻辑和运行机理加以体现的。“湟里西墅法治乡村模式”的内生性制度逻辑基点是对法治的价值认同;“湟里西墅法治乡村模式”的外生性制度逻辑基点是法治经济发展的需求。“湟里西墅法治乡村模式”以乡村公共法律服务为保障、以乡村治理主体多元化为依托、以系统性和渐进性为遵循。保障乡村公共法律服务的可得性和高质量;注重乡贤文化的充分利用,以乡贤的德治建设促进法治建设;坚持系统观念,发挥乡规民约等软法规范作用,营造较为良好的法治文化氛围,形成法治的内循环和整体治理的外循环,实现乡村法治建设的新路径。

Under the rural revitalization strategy,the construction of the rule of law in rural areas is extremely important,and it is continuously mentioned in the national strategic deployment and top-level design documents.The construction of the rule of law in rural areas has become an important part of the national governance system and an important manifestation of the modernization of the rule of law in Chinese style.It is necessary and feasible to practice the construction of the rule of law in rural area.The“law-based rural model in Xishu,Huangli”is a typical practical approach to the construction of rural areas under the rule of law from the perspective of rural revitalization.This typicality is reflected in the systematic logic and operating mechanism.The endogenous institutional logic basis of the“law-based rural model in Xishu,Huangli”is the value recognition of the rule of law;the exogenous institutional logic basis of the“law-based rural model in Xishu,Huangli”is the demand of the legal economy development.The“law-based rural model in Xishu,Huangli”is guaranteed by rural public legal services,based on the diversification of rural governance subjects,and followed by systematicness and gradualness.This model can guarantee the availability and high quality of rural public legal services;it can pay attention to the full utilization of the rural sage culture,and promote the construction of the rule of law with the construction of the rule of virtue by the rural sages;it can adhere to the systematic idea,and play the role of soft laws and norms such as rural regulations and civil agreements,and create a relatively good cultural atmosphere of rule of law,form an internal circulation of the rule of law and an external circulation of the overall governance,and create a new path for the construction of the rule of law in rural areas.
