摘要
电子商务领域的“二选一”行为不仅具有排除限制竞争以及数据垄断的风险,而且会侵害平台内部经营者与普通消费者权益。在我国现行竞争法体系中,虽然《中华人民共和国反垄断法》《中华人民共和国反不正当竞争法》《中华人民共和国电子商务法》都能对“二选一”行为进行规制,但其仍然具有一定局限性。为了实现对“二选一”的有效规制,应从明确竞争法规体系内部的法律条款关系、明确“二选一”行为的竞争法规制原则、完善《中华人民共和国反垄断法》对“二选一”行为的规制框架以及重新设计《电子商务法》第三十五条规定着手,引导电子商务领域经营者依法合规经营,促进线上经济持续健康发展。
The"two choice"behavior in the field of e-commerce not only carries the risk of excluding restrictive competition and data monopoly,but also infringes on the rights and interests of internal platform operators and ordinary consumers.In China's current competition law system,although the Anti monopoly Law of the People's Republic of China,the Anti unfair competition Law of the People's Republic of China,and the E-commerce Law of the People's Republic of China can regulate the"one out of two"behavior,it has certain limitations,which not only damages the substantive fairness and justice,but also destroys the market competition order.In order to achieve effective regulation of"one out of two"behavior,it is necessary to clarify the legal provisions within the system of competition regulations,clarify the principles of competition law regulation for"one out of two"behavior,improve the regulatory framework for"one out of two"behavior in the Anti Monopoly Law of the People's Republic of China,and redesign Article 35 of the E-commerce Law to guide operators in the field of e-commerce Operate in accordance with the law and regulations to promote the sustained and healthy development of the online economy.
