新时代人民法院“执源治理”问题研究

Research on the Issue of“Governing the Origins of Judicial Enf orcement”in the People’s Courts of the New Era

为深入贯彻落实习近平总书记关于“抓前端、治未病”重要指示,贯彻落实中央关于“从源头上减少诉讼增量”明确要求,把最高人民法院张军院长关于“解决执行难问题还要深化,执行难的源头问题要思考”具体要求落到实处,最高人民法院执行局通过实地调研、书面调研、座谈交流等多种方式,开展了新时代人民法院“执源治理”问题专题调研。调研主要从人民法院内部着手,同时兼顾执行联动、综合治理等外部工作,深入查找分析当前“执源治理”中存在的主要问题,提出对策建议,以期能更好推动矛盾纠纷实质化解,进而从源头上减少执行案件数量,推动解决“执行难”问题。

To thoroughly carry out General Secretary Xi’s instruction to“emphasize early stages and prepare beforehand”,to fulfill the Central Committee’s explicit requirement of“reduce surges in litigation from the source”,and to execute Chief Justice Zhang Jun’s direction to“dive deeper into the problem of judicial enforcement and consider broader of the origin of the difficulties hereof”,the Enforcement Bureau of People’s Supreme Court had undertaken to compose a themed study on“Governing the Origins of Judicial Enforcement”by conducting series of field research,academic research,and academic forums.The study is focused on the internal aspects of the People’s Court’s operations,whilst taking into consideration external factors such as judicial cooperation and universal governance,to discover the current key issues with the principle of Governing the Origins of Judicial Enforcement and offer theoretical and practical solutions and recommendations,to accelerate the resolution of judicial disputes thereby leading to reductions in the numbers of judicial enforcement cases,and ultimately,fuel the resolution of the problems in judicial enforcement.
