Efficiency and Benefit:Evolution Logic of Urban Management Law Enforcement Mode

本研究根据街头官僚理论,通过具体案例分析了城管的单独执法、联合执法和综合执法。研究发现,效率和效益贯穿城管执法全过程,形成城管执法方式的演变逻辑。其中,单独执法以强制执法为主,通过罚款、驱赶、拆除等方式追求执法效率;联合执法由强制执法向非强制执法转变,通过引导、疏通等方式追求执法效率时注重执法效益;综合执法以非强制执法为主,通过疏通、帮助等方式提高执法效率和执法效益。从单独执法到联合执法再到综合执法,它是从提高执法效率到提高执法效率时兼顾执法效益,再到提高执法效率和执法效益的过程。

Under the guidance of street bureaucracy theory,this paper analyzes the individual law enforcement,joint law enforcement and comprehensive law enforcement of urban management through specific cases.It is found that efficiency and benefit run through the whole process of urban management law enforcement,forming the evolution logic of urban management law enforcement methods.Among them,the independent law enforcement focuses on compulsory law enforcement,and pursues law enforcement efficiency through fines,eviction and demolition;Joint law enforcement changes from compulsory law enforcement to non-compulsory law enforcement,and pays attention to law enforcement benefits when pursuing law enforcement efficiency through guidance and dredging;Comprehensive law enforcement is mainly based on non-compulsory law enforcement,and the efficiency and benefit of law enforcement are improved by dredging and helping.From individual law enforcement to joint law enforcement to comprehensive law enforcement,it is a process from improving law enforcement efficiency to giving consideration to law enforcement efficiency,and then improving law enforcement efficiency and law enforcement efficiency.
