矿产资源开发管理中相关问题解决策略研究

Research on Problem-solving Strategies for Mineral Resources Development and Management

针对目前矿业权市场中普遍存在的“圈而不探”“以采代探”以及“占而不采”问题,在分析问题产生原因的基础上,结合国家相关法律法规、其他省(区)出台的政策文件以及新疆维吾尔自治区实际情况,提出解决问题的相关方案,为完善矿业权管理制度,促进矿产勘查和开采市场健康有序发展提供可借鉴的措施和建议。对于“圈而不探”问题,建议通过加强勘查实施过程中监督管理力度并实施目标责任制管理制度来解决;对于“占而不采”问题,建议通过完善采矿权出让合同并加强对最小生产规模的监管力度来解决;对于“以采代探”问题,建议通过加强日常监管力度并实行信用监管建立处罚制度来解决。

To solve the common problems of"obtaining exploration rights but not explored","replacing exploration with mining"and"possessing mining rights without mining"in the mining rights market,according to the analysis of the causes of the problem,this study aimed to put forward relevant suggestions to solve the problem by combining with relevant national laws and regulations,policy documents issued by other provinces(regions)and the actual condition of Xinjiang Uygur Autonomous Region of China.It provides reference measures and suggestions for the autonomous region to improve the mining rights management system and promote the healthy and orderly development of mineral exploration and mining market.Through this research,it was found that for the problem of"obtaining exploration rights but not explored,"strengthening supervision and management during the exploration process and implementing a target responsibility management system would be effective solutions.For the issue of"possessing mining rights without mining",improving mining rights transfer contracts and strengthening supervision of minimum production scales are recommended.Finally,to address the issue of"replacing exploration with mining,"daily supervision should be strengthened,and a credit supervision penalty system should be established.
