在数字经济高速发展的背景下,平台利用数据拒绝互联互通的行为已经产生了破坏竞争秩序、限制公平交易等负面效果。作为应对数字垄断的重要举措,平台间数据互操作在适用过程中仍面临一系列问题,如主体权属不明、数据风险加剧、创新遭受遏制等问题,这些问题使构建数据互操作规则具有现实紧迫性。对此,我国可以通过分析互操作的法律维度,在借鉴国际数据互操作经验的基础上,从清晰划分适用主体;保障数据隐私安全;调动市场积极创新力量;充分发挥执法监管的作用,实现平台互联互通等方面进行规则的完善,以此促进数字经济的有序发展。

In the context of the rapid development of the digital economy,the behavior of platforms using data to refuse interconnection has produced negative effects such as damaging the order of competition and restricting fair trade.As an important measure to deal with digital monopoly,data interoperability between platforms still faces a series of problems in the application process,such as unclear ownership of the subject,intensified data risks,innovation is curtailed,etc.These problems make the construction of data interoperability rules with realistic urgency.In this regard,China can clearly classify the applicable subjects by analyzing the legal dimension of interoperability and drawing on the experience of international data interoperability.Ensure data privacy security;Mobilize the market's active innovation force;Give full play to the role of law enforcement and supervision,and improve the rules in terms of platform interconnection,so as to promote the orderly development of the digital economy.
