摘要
数字经济的发展正在改变着传统的就业模式,数字技术支撑的平台经济催生出一大批新就业形态,表现出灵活多样的从业形式和就业特征。这些新型就业形态的用工类型较以往的标准化用工发生了很大的变化,平台、代理商、从业者等多方主体的存在使劳动关系界定复杂化,传统劳动关系的认定标准已无法完全适用于平台的新型用工关系。积极面对技术发展引致的社会结构调整,加强对新就业形态劳动者的社会保护,是经济社会协调发展的内在需求。
The development of digital economy is changing the traditional employment model,and the platform economy supported by digital technology has spawned a large number of new employment forms,showing flexible and diverse employment forms and employment characteristics.The employment types of these new forms of employment have undergone earth-shaking changes compared with the previous standardized employment,and the existence of platforms,agents,practitioners and other parties has complicated the definition of labor relations,and the identification standards of traditional labor relations can no longer be applied to the new employment relations of platforms.Actively facing the adjustment of social structure caused by technological development and strengthening the social protection of workers in new employment forms is an inherent demand for coordinated economic and social development.
