行政规范性文件审查衔接联动机制:实践现状、功能定位与制度设计

摘要 我国行政规范性文件审查监督体系已经具备了多元共治的基本形态,但“并行式”的审查具有较大的分散性,面临着单一主体审查能力不足和多元主体审查存在潜在冲突的现实困境。审查衔接联动机制的建构,一方面能够通过多元主体间的有效互动,提供“个体借力”的稳定渠道,从而提高各主体独立审查的能力和实效;另一方面借由信息和专业优势的整合,增强协同效力形成监督合力,以实现“整体大于部分之和”的“整体发力”功能。在维护法制统一的目标统合、共识型纠错模式的现实需求以及权力协同监督的运行逻辑下,衔接联动机制成为审查监督体系良性运转的关键装置。进一步,应确立并完善移送审查、沟通会商、联席会议和研讨培训等制度,以保障机制的有效运行。 The system for the review and supervision of the filing of Administrative Normative Documents has the basic form of multiple co-governance.But working in parallel is relatively decentralized,and faces the practical dilemma of insufficient review capacity by a single subject and potential conflicts in the review of multiple subjects.On the one hand,the Connection and Interaction Mechanism can provide a stable channel of“individual leverage”through the effective interaction between multiple subjects,thereby improving the ability and effectiveness of each subject’s independent review;on the other hand,through the integration of information and professional advantages,enhance synergy and form a synergy of supervision to achieve the function of“whole force”.Under the realistic needs of the goal integration of maintaining the unity of the national legal system,the consensus-based error correction model,and the operation logic of power coordination and supervision,the Connection and Interaction Mechanism will become a key device for the healthy operation of the review and supervision system.Systems such as referral for review,communication and consultation,joint meetings and seminars and training should be established.
