当数据集合通过算法加工体现一定的智力成果和创造性劳动,具有在特定场景下发挥使用价值的前提,应对这部分数据进行赋权,即数据知识产权。在实现路径上,数据产品可通过登记达成数据知识产权确权的目的;通过算法审查,当数据达到一定程度的智力成果后能得到知识产权行政程序确认;通过设定应用场景,使数据满足知识产权实用性的要求。

When the data collection embodies certain intellectual achievements and creative labor through algorithmic processing,and has the premise of exerting the value of use in specific scenarios,this part of the data should be empowered,i.e.,data intellectual property rights.In the realization path,data products can be registered to achieve the purpose of data intellectual property rights;through the algorithmic review,the data that reach a certain degree of intellectual achievements can be confirmed by the intellectual property rights administrative procedures;through the setting of application scenarios,so that the data can meet the requirements of intellectual property rights utility.
