《海上交通安全法》框架下船员权益保障问题研究

Study on the Protection of the Rights and Interests of Seafarers within the Framework of the Maritime Traffic Safety Law

梳理了《中华人民共和国海上交通安全法》(以下简称新《海安法》)对船员权益保障问题的新增规定,针对船员职业的特殊性,对我国船员权益保障司法现状进行分析,从船员权益保障的立法、船员权益保障机制、主体责任落实、法律意识和知识培训等4个方面,提出并分析新《海安法》下船员权益保障的问题及相应对策。

This paper studies the newly added provisions of the revised Maritime Traffic Safety Law on the protection of seafarers'rights and interests,analyzes the current judicial situation of the protection of seafarers'rights and interests in the light of the special characteristics of the seafarer occupation.Furthermore,it probes into the existing problems and proposes corresponding countermeasures for the protection of seafarers'rights and interests under the new Maritime Traffic Safety Law from the four aspects of legislation,mechanism,implementation of main responsibilities,legal awareness and relevant training.
