The Lawful Exercise of the Right of Hot Pursuit in Accordance wi th the Maritime Traffic Safety Law

海上紧追权是沿海国家在海洋执法中的重要权力,新《海上交通安全法》引入紧追权制度,但是目前由于多头执法主体、执法程序不明确、立法碎片化等一系列问题,我国紧追权还处于起步阶段,急需程序、职责上的进一步细化,提升紧追权的可操性。

The right of hot pursuit at sea is an important power of coastal States in maritime law enforcement.The Maritime Traffic Safety Law revised in introduced the right of hot pursuit.However,due to a series of problems such as multiple law enforcement subjects,unclear law enforcement procedures and fragmentary legislation,it is still in the initial stage in China,and more detailed procedures and responsibilities are in urgent need aiming at enhancing the feasibility of the right of hot pursuit.
