Application of Behavior Preservation in Patent Infringement Litigation on E-Commerce Platforms:Review and Optimization

平台经济是数字经济的重要组成部分,平台的治理能力和效果关系数字经济的健康发展。大力发展数字经济的宏观规划离不开微观层面具体规则的运行。行为保全规则在电商平台专利侵权治理方面的作用不容小觑。相比单独适用,行为保全与“通知-删除”规则和停止侵权的先行判决,以及动态担保金的共同适用能够发挥出更强的及时止损功能优势。然而,实践中较高的担保数额、不合理的审查期限以及较低的适用率等问题削弱了行为保全的适用潜能。理论层面,利益衡量论和路径依赖论可为前述问题的解决提供思路。实践层面,建议根据行为保全申请的释明程度灵活调整担保数额,合理确定审查期限提高行为保全裁定的质效,激发裁定适用率以释放行为保全的功能优势,以此推动平台经济的高质量发展。

The platform economy is an important part of the digital economy,and the governance ability and effectiveness of the platform are related to the healthy development of the digital economy.The macro planning of vigorously developing of digital economy cannot be separated from the operation of specific rules at micro level.The role of behavior preservation rules in the governance of patent infringement on e-commerce platforms should not be underestimated.Compared with separate application,the joint application of behavior preservation with the“removal upon notice”regulation,advanced judgment to stop infringement and dynamic security deposit can play a stronger functional advantage.However,in practice,the high amount of security,the unreasonable review period and the low application rate have weakened the potential application of behavior preservation.At the theoretical level,the theory of interest weighing and the theory of path dependence can provide ideas to solve the aforementioned problems.At the practical level,it is suggested that the amount of security should be flexibly adjusted according to the degree of explanation of the behavior preservation application,the review period should be reasonably determined to improve the quality and effectiveness of the behavior preservation ruling,and the application rate should be stimulated to release the functional advantages of behavior preservation in order to promote the high-quality development of the platform economy.
