INGO对华“灰色区域”贸易措施的国际法规制困境与应对

The International Legal Regulation Dilemma and Countermeasures of INGO's"Grey Area"Trade Measures towards China

2021年3月下旬,瑞士良好棉花发展协会(BCI)决定暂停对新疆良好棉花的认证,并与其部分会员企业联合抵制新疆棉花,对我国棉花产业及相关企业在国际市场上的正常竞争和贸易产生一定的限制影响。BCI因具有国际非政府组织属性,其决定构成对华“灰色区域”贸易措施,游离于国际法规则管制之外。《中华人民共和国反外国制裁法》的出台恰逢其时,BCI及其决定适用于对该法规范的外国组织行为予以调整。美国等个别国家利用国际非政府组织,补充其对华制裁广度和深度的行为,应引起我国重视。有关部门可根据《反外国制裁法》相关规定,将此类组织列入反制清单,并采取相应制裁措施。我国受损企业或个人亦可依据该法及相关法律,向人民法院提起诉讼,请求停止侵害并赔偿损失。

In late March 2021,Better Cotton Initiative(BCI)Switzerland decided to suspend the certification of Xinjiang better cotton and launched its so-called Xinjiang cotton boycott with some of its member enterprises,which places certain restrictions on the normal competition and trade of China's cotton industry and related enterprises in the international market.As an International Non-Governmental Organization,the decision of BCI constitutes"grey area"measuretrade measures towards China,which deviates from the regulation of international law.The Anti-Foreign Sanctions Law was issued at the right time.BCI and its decisions were applied to the acts of foreign organizations regulated by the law.United States and other individual countries that used International Non-Governmental Organizations to supplement the breadth and depth of their sanctions against China should be taken seriously by China.In accordance with relevantprovisions of the Anti-Foreign Sanctions Law,the relevant departments may include such organizations in the Countermeasure List and take corresponding sanctions.The damaged enterprises or individuals can also file a lawsuit to the court to stop the infringement and compensate for the losses in accordance with the law and relevant laws.
