我国居住权制度的研究热点、发展进程与未来展望——基于CiteSpace的数据可视化分析

The Research Hotspot,Development Process and Future Prospect of Residence Right in China——Data Visualization Analysis Based on CiteSpace

《民法典》居住权制度是我国的一项新兴用益物权制度,通过对我国居住权的研究进程及热点进行梳理,旨在帮助相关领域学者了解其研究现状及发展方向,为未来拓展研究、改善实践提供理论支持和参考。为此,借助CiteSpace软件对CNKI数据库“SCI”“CSSCI”等核心期刊中“居住权”主题的381篇有效文献进行可视化分析,并通过文献分析法总结研究现状及其不足。研究表明,居住权研究在数量上波动上升;在学科领域方面仍以法学为主,需开拓多元领域;在内容上内涵渐进,但制度细节还有待填补。因此,未来居住权的研究还应进一步拓展研究广度,开拓学科视野;同时加大研究深度,充实制度体系细节。

The residence right system in the Civil Code is a new usufructual-property right system in our country.By reviewing the research process and hot spots of the residence right in our country,this paper aims to help scholars in related fields understand its research status and development direction,and provide theoretical support and reference for future research expansion and practice improvement.To this end,CiteSpace software was used to visually analyze 381 effective papers on the topic of“residence right”from CNKI database“SCI”,“CSSCI”and some other core journals,and the current research status and shortcomings were summarized through literature analysis.The study shows that the number of residence studies fluctuates and increases on the whole.In terms of subject areas,the law remains as the key research field,which needs to be extended to multiple fields.The content is upgrading,but the details of the system need to be filled.Therefore,the future study of residence rights should further expand the scope of research with a broader vision.At the same time,it calls for in-depth research andn richful details of the system.
