我国艺术品追续权制度研究

Research on the System of the Resale Royalty Right of Artistic Works in China

艺术品追续权制度源于法国。随着《伯尔尼公约》和欧盟《追续权指令》的相继确认,追续权制度从欧洲走向了世界。我国在《著作权法》第三次修订过程中,一度将追续权吸收进立法草案中。追续权保护了艺术家的利益,顺应了知识产权平衡利益的价值目标。随着知识产权强国战略的不断推进,我国应从立法上确认追续权制度,并将其客体范围限于美术作品。同时,拓宽权利主体的范围,将受遗赠人纳入其中。至于权利的行使方式,可以由集体管理机构代为行使。

The system of the resale royalty right of artistic works originated from France.With the successive confirmation of the"Berne Convention"and the EU's"Droit de Suite",the system of resale royalty right system has moved from Europe to the world.In the process of the third revision of the"Copyright Law"in China,the resale royalty right was once absorbed into the draft legislation.The resale royalty right protects the interests of artists and conforms to the value goal of balancing the interests of intellectual property rights.With the continuous advancement of the strategy of strengthening the country with intellectual property rights,China should legislate to confirm the system of resale royalty right and limit its object scope to art works.At the same time,we should broaden the scope of the subject of rights and include the legatee.As for the exercise of rights,it can be exercised by collective management agencies.
