摘要
凭借对强大的数据资源的占有,算法技术逐渐披上了“权力的外衣”,随之而来也打破了原有的“权利”制约“权力”的平衡,出现算法权力异化问题。算法权力异化背景下,看似中立的算法技术,通过自动化决策与自动化评分等方式,将传统社会固有的性别歧视隐蔽式放大,使得劳动就业领域的法律保护机制失灵,算法权力与劳动权利的互动失衡。为此,应搭建用于劳动的自动化决策的第三方对话机制,从多领域实现对算法性别歧视规范体系的结构性扩容,确立算法治理中人的主体地位,以避免算法权力异化带来的劳动就业领域的性别歧视。
By virtue of the possession of vast data,algorithm gradually put on the“coat of power”,and subsequently has broken the original constraints of“rights”on the“power”,leading to the alienation of algorithmic power.In this context,the seemingly neutral algorithmic technology secretly magnifies the inherent gender discrimination in the traditional society by means of automatic decision⁃making and automatic scoring.Consequently,the legal protection mechanism in the field of labor and employment fails,and the interaction between algorithm power and labor rights becomes unbalanced.To this end,a third⁃party dialogue mechanism for automated labor decision⁃making should be built to achieve the structural expansion of the algorithm gender discrimination standard system in multiple sites,and establish the dominant position of people in algorithm governance.By doing so,it is expected to avoid gender discrimination in the field of labor and employment caused by the alienation of algorithm power.
