Research on Privacy Protection of Juvenile Community Correction Objects from the Perspective of Specialized Correction

在对未成年社区矫正对象与成年社区矫正对象分别进行社区矫正的语境下,未成年犯罪人的社区矫正应该走向专门化和多元化。加强对未成年社区矫正对象的隐私权保护,无论是从国家刑罚权、公共利益的实现还是从落实未成年人最大利益原则的角度来看都具有正当性。隐私权和个人信息权在概念外延上具有交叉关系,未成年社区矫正对象隐私权保护的主要难点在于对隐私信息这一客体的保护上。未成年社区矫正对象隐私权的内涵主要包括对其隐私权客体的支配权、利用限制权、受保护权。未成年社区矫正对象隐私权的保护应该选择单行式的独立保护模式,而不是分散式的附属保护模式。其远景目标是要构建起单行的少年法典、独立的少年司法体系、专业化的未成年人社区矫正项目、完备的未成年人社区矫正配套机制。

In the context of juvenile community correction and adult community correction,juvenile community correction should be specialized and diversified.Strengthening the right to privacy protection of juvenile community correction objects is justified from every perspective,whether from the realization of the national penalty right,public interests,or the implementation of the principle of the best interests of juveniles.The right of privacy and the right of personal information have a cross relationship in the extension of the concept.The main difficulty in the protection of the right of privacy of the juvenile community correction object lies in the protection of the object of privacy information.The connotation of the right of privacy of the juvenile community correction object mainly includes the right to control,the right to restrict the use and the right to be protected.The mode of privacy protection of juvenile community correction objects should choose the single-line independent protection mode,rather than the decentralized subsidiary protection mode.The long-term goal is to build a single juvenile code,an independent juvenile justice system,a professional juvenile community correction project,and a complete supporting mechanism for juvenile community correction.
