未成年人监护权检察监督的实务观察与制度重构

Practical Observation and Institutional Reconstruction of Prosecutorial Supervision over the Guardianship of Minors

党的二十大报告强调“加强检察机关法律监督工作。”未成年人检察工作作为法律监督工作的重要组成部分理应加强,探索构建检察机关参与的未成年人监护权监督制度正当其时。以C直辖市检察机关的司法实践作为样本进行分析,可以发现当下的未成年人监护权检察监督工作成效斐然,但还存在监督法律体系尚不完善、监督衔接机制存在缺失、监督实施方式不够健全等问题。应立足于司法实践需要,总结未成年人监护权检察监督工作经验,从完善立法规定,坚持保护原则,明确考察方式,健全预防机制,细化社会体系,深化融合履职等六个方面构建完备的未成年人监护权检察监督制度。

The report of the 20th National Congress of the Communist Party of China pointed out that"strengthening the legal supervision work of procuratorial organs."As an important component of legal supervision work,juvenile procuratorial work should be strengthened,and it is timely to explore the construction of a supervision system for the guardianship of minors with the participation of procuratorial organs.Taking the judicial practice of the procuratorial organs in the C municipality as a sample for analysis,it can be found that the current procuratorial supervision work on the guardianship of minors has achieved remarkable results,but there are still problems such as an imperfect legal system for supervision,a lack of supervision linkage mechanisms,and inadequate supervision implementation methods.Therefore,based on the needs of judicial practice,we should explore and summarize the experience of the procuratorial supervision of minors′guardianship,and build a complete procuratorial supervision system for minors′guardianship from six aspects:improving legislative provisions,adhering to the principle of protection,clarifying inspection methods,improving prevention mechanisms,refining the social system,and deepening the integration and performance of duties.
