综合行政执法改革的善治逻辑——基于浙江龙港的案例研究

Good Governance Logic of Reform in Comprehensive Administrative Law Enforcement——Based on the Case Study of Longgang in Zhejiang Province

“城管困境”意味着参与各方都成为输家,其本质是在管制模式下单边主导与多元需求、权力集中与职责分散、长官意志与公民权利之间的矛盾和冲突。浙江龙港在全国首次开展县域“一支队伍管执法”,并开启“一支队伍善执法”探索。通过自我改革保证合法正当、互动合作支持共治共享、秩序重构维持弹性平衡,在很大程度上化解了城管困境,并实现向善治的蝶变。这对我国综合行政执法改革具有重要启发意义。

"The dilemma of city management"means that all parties involved become losers.Its essence is the contradiction and conflict between unilateral dominance and multiple demands,power concentration and responsibility dispersion,the will of the chief and the rights of citizens under the regulation mode.Longgang in Zhejiang Province carried out the policy of""One Team for Managing Law Enforcement"at the county level for the first time in China,and explored the practice of"One Team for Good Law Enforcement".These policies have ensured legality and legitimacy through self-reform,supported governance and sharing through interactive cooperation,and maintained elasticity and balance through order reconstruction,which has resolved"the dilemma of city management"to a great extent,so that the evolutionary transform of law enforcement towards good governance could be realized.This is of great significance to the reform of comprehensive administrative law enforcement in China.
