Establishing the International Organization for Mediation:Context,Basis and Progress

近年来,国际社会对调解的需求日益增加,但目前国际上还没有专司调解的政府间国际组织。2022年以来,中国与持相近理念的国家签署了《关于建立国际调解院的联合声明》,决定共同发起建立国际调解院。国际调解院将是一个由各方共同协商建立、以条约为基础的政府间国际法律组织,致力于专门提供调解服务,为各类国际争端提供友好、灵活、经济、便捷的解决方案。国际调解院是对现有争端解决机构和争端解决方式的有益补充,将为和平解决国际争端提供一个新的平台,对促进国际和平安全发展和国际秩序稳定具有重要意义。国际调解院筹备办公室于2023年2月16日在中国香港特别行政区成立,根据《关于建立国际调解院的联合声明》的授权负责组织协调各方开展建立国际调解院的公约谈判,预计两三年内完成公约谈判并设立国际调解院。

In recent years,there has been a growing demand for mediation in the international community.However,currently there is no intergovernmental organization dedicated to mediation.Since 2022,China and relevant countries sharing similar ideas have signed the Joint Statement on the Establishment of the International Organization for Mediation and decided to jointly launch the establishment of the International Organization for Mediation(hereinafter referred to as the IOMed).The IOMed will be a treaty-based intergovernmental legal organization established through consensus-building by parties concerned.It is commited to providing dedicated mediation services and offering friendly,flexible,cost-effective,and convenient solutions for various international disputes.The IOMed will be a valuable complement to existing dispute settlement mechanisms and methods,and will provide a new plaform for the peaceful settlement of international disputes,which is of great significance for promoting international peace,security,development,and the stability of the international order.The IOMed Preparatory Office was established in the Hong Kong SAR of the People's Republic of China on February 16,2023.It has been entrusted,according to the Joint Statement,with a mandate to coordinate and organize formal elaboration on the IOMed Convention and other related matters among prospective founding members.The Convention will be the constituent instrument of the IOMed and will provide the framework for the establishment and operation of the IOMed,such as legal status,purposes and functions,the headquarters,member states,governance structure,decision-making mechanisms,financing,privileges and immunities,etc.It will also cover how the IOMed provides mediation services,such as the scope of cases,mediation procedure,and the legal effect and enforcement of settlement agreements resulting from mediation under the IOMed.It is expected that elaboration on the IOMed Convention will be completed within two to three years,leading to the establishment of the IOMed.
