我国船载有毒有害物质污染损害赔偿基金建构研究

Research on the Construction of Compensation Fund for the Damages Resulting from Pollution by Shipborne Toxic and Harmful Substances in China

近年来我国船载有毒有害物质污染事故时有发生,对海洋环境保护造成较大压力,同时因载运有毒有害物质船舶缺乏污染损害保障机制而难以实施相应救济。在深入分析建构我国船载有毒有害物质污染损害赔偿基金的必要性和可行性的基础上,参照国际油污基金对有毒有害物质污染损害赔偿基金的管理方式,提出建构我国船载有毒有害物质污染损害赔偿基金的路径,为最终实现建构我国船载有毒有害物质污染损害赔偿基金奠定坚实基础。

Recent years have witnessed occasional occurrences of pollution accidents resulting from shipborne toxic and hazardous substances pollution accidents in China,which results in greater pressures of marine environment protection.At the same time,it is difficult to implement the corresponding reliefs due to the shortage of guarantee mechanism of shipborne toxic and harmful substances.A way is advanced to construct pollution compensation fund for China’s shipborne toxic and hazardous substances on the basis of in-depth analysis of the necessity and feasibility of constructing the pollution compensation fund of China’s shipborne toxic and hazardous substances so as to lay a solid foundation for the pollution compensation fund of eventual realization of China’s shipborne toxic and hazardous substances,thus promoting the improvement of China’s shipborne pollution damage compensation system.
