数字赋能刑事审判与司法辅助人员的职能重构

Reconstruction of theFunctions of Judicial Auxiliary Personnel in Criminal Digital Empowerment Trials

随着大数据、云计算、人工智能、互联网+等技术的迅速发展,信息化日新月异,但由数字化所带来的一系列问题尚处于规制欠缺的状态,其中就包括在数字赋能庭审中新技术与传统司法辅助人员职能的冲突。该冲突总体上表现为,司法辅助人员职能相对弱化并模糊不明,部分司法辅助人员职能可替代性增强,少数职能呈现缺位状态。这些冲突主要由理论变革、技术变革、司法场域变革所形成。理论变革导致传统正义向数字正义的转型,技术变革导致数字化庭审与传统庭审构造的冲突,司法场域变革导致智能辅助办案系统与司法辅助人员职能冲突。为应对和解决以上问题,可以从司法辅助人员职能的再界定、司法辅助事务的再分配与司法辅助资源的再调配入手进行改革,以不断适应数字赋能审判的发展趋势。

With the development of information technologies such as big data,cloud computing,artificial intelligence,Internet plus and other technologies,informatization has changed with each passing day,but digitalization is still in its infancy,and a series of problems brought about by digitalization are still unregulated,including the conflict between new technologies and traditional judicial support personnel functions in digitally-enabled trials.The conflict is manifested in the ambiguity of the overall functions of judicial auxiliary personnel,the increased substitution of some judicial auxiliary functions,and the vacancies in a small number of functions.The causes of these conflicts are composed of theoretical changes,technological changes,and judicial changes.Theoretical changes have led to the transformation of traditional justice to digital justice,technological changes have led to conflicts between digital trial and traditional court structure,and judicial field changes have led to conflicts between intelligent case-handling systems and judicial auxiliary personnel.In order to solve the above problems,we can start with the redefinition of the duties of judicial auxiliary personnel,the redistribution of judicial auxiliary affairs and the redeployment of judicial support resources to continuously adapt to the development trend of digital empowerment trials.
