百年变局加速演进背景下,政治外交博弈中的法律之争加剧,在国际秩序、区域主义、意识形态、国际法规则解释适用、国家管辖权方面国际法斗争激烈。围绕全球公域、全球公共产品、全人类共同价值而展开的众多国际立法进程中,各国纷纷抢抓规则制定主动权。国际司法机构作用更加受到高度重视,在政治外交博弈中的地位不断上升。《对外关系法》《外国国家豁免法》陆续出台,中国涉外立法取得重大进展。

As transformation unseen in a century unfolds at a faster pace in our world,competition in international law is heating up as part of inter-state political and diplomatic competition,especially in the fields of international order,regionalism,ideology,interpretation and application of international law,and jurisdiction of States.States are seeking to dominate the international law-making process in such areas as global commons,global public goods,and common values of humanity.Greater importance has been attached to international judicial institutions that are playing an ever more significant role in political and diplomatic competition.With the adoption of The Law on Foreign Relations of the People's Republic of China and The Law of the People's Republic of China on Foreign State Immunity,China has made significant progress in its foreign-related legislative work.
