财政资助下科技成果知识产权政府介入权解析

Research on the Right of Government Intervention on Intellectual Property Rights ofScientific and Technological Achievements under Financial Assistance

为进一步加强对财政资助下科技成果知识产权的“放权让利”,我国再次对《科技进步法》第32条进行了修订。但是,作为条款核心的政府介入权制度却并未得到实质性完善,政府介入权实体法规范模糊、行使及救济程序缺失、配套制度规范不足等问题仍然存在,一定程度上导致在实践中政府鲜少行使介入权,未有效发挥出监督者、协助者和推动者的作用。因此,明确政府介入权的介入类型、行使主体、行使方式、作用对象等实体法内容,完善政府介入权的行使及救济程序,建立财政资助项目知识产权信息披露制度、收益反哺机制等配套制度,成为推动财政资助项目科技成果知识产权转化运用的破局关键。

In order to further strengthen the"decentralization and concession"of intellectual property rights of scientific and technological achievements under financial assistance,China has once again revised Article 32 of the Law on Scientific and Technological Progress.However,the system of government intervention power,which is the core of the provisions,has not been substantially improved,and there are still problems such as the vagueness of the substantive legal norms of the government intervention power,the lack of exercise and relief procedures,and the lack of supporting system norms.To a certain extent,this has led to the fact that in practice,the government rarely exercises the right to intervene and does not effectively play the role of supervisors,facilitators and promoters.Therefore,it is necessary to clarify the substantive law content such as the type of intervention,the subject of the exercise,the method of exercising,and the object of the government's intervention,improve the exercise and relief procedures of the government's intervention right,and establish supporting systems such as the intellectual property information disclosure system and the income feedback mechanism for financially funded projects,which have become the key to promoting the transformation and application of intellectual property rights in scientific and technological achievements of financially funded projects.
