我国体育慈善事业的立法现状、难点审视及对策研究

Research on the Legislative Status,Difficulties,and Countermeasures of Sports Philanthropy in China

体育慈善作为慈善事业的重要内容,是国家进行第三次分配的方式之一。采用文献资料法、文本分析法、逻辑分析法等方法,探讨了我国体育慈善事业的立法现状,并从法律的角度分析了体育慈善事业的发展难点和解决策略。研究发现,体育慈善事业面临的发展难点有:体育慈善的特殊性与慈善法律的滞后性造成的法律空白;普通慈善的高标准与体育慈善的落后性产生的进入壁垒;政府监督、内部监督与社会监督存在难题;体育慈善参与主体因慈善意识和法律知识淡薄有违法、违规行为。对于体育慈善事业发展难点的破解之道,认为:填补法律空白是前提;降低准入门槛是关键;健全监督机制是重点;加强法律宣传是基础。

Sports charity,as an important part of charity,is one of the ways in which the country conducts the third distribution.Using methods such as literature review,text analysis,and logical analysis,this paper explores the legislative status of sports charity in China,and analyzes the development difficulties and solutions of sports charity from a legal perspective.Research has found that the development difficulties faced by sports charity include:the legal gap caused by the particularity of sports charity and the lag of charity laws;The high standards of ordinary charity and the backwardness of sports charity create entry barriers;There are difficulties in government supervision,internal supervision,and social supervision;The participants in sports charity have violated laws and regulations due to their weak awareness of charity and legal knowledge.For the solution to the difficulties in the development of sports charity,it is believed that filling the legal gap is the prerequisite;Lowering the entry threshold is the key;Strengthening the supervision mechanism is the key;Strengthening legal publicity is the foundation.
