试论创作者经济及其法律规制

On Creator Economy and Its Legal Governance

创作者经济是依托于互联网平台产生并发展的一种重要经济模式。当前,创作者经济面临注意力代偿盈利阻碍可持续发展、平台强可控性背离去中心化趋势、包容审慎监管规则在实践中难以平衡等问题。未来,应以“协调主义”为理论基础,围绕协调多方主体利益、既有的法律基础与新的网络环境及治理主体的权利义务分配等方面,构建创作者经济法律治理的协调机制,保障创作者经济的有序健康发展。具体而言,创作者经济的法律规制需要同时考虑平台的私主体地位和公共管理角色,解决平台代码和技术内在的法律风险,并从“世界数字化”的高度审视创作者数据的生产要素意义。

Creator economy is an important economic model based on the Internet platform.Currently,creator economy faces a series of problems,such as the obstruction of sustainable development by attention compensation profit,the strong controllability of the platform deviating from the trend of decentralization,and the difficulty in balancing the accommodative and prudential regulatory rules in practice.Based on the coordination theory,the coordination mechanism of the legal governance of creator economy should be constructed around the coordination of the interests of multiple subjects,the old legal basis,the new network environment,and the distribution of the rights and obligations of the governing subjects,so as to guarantee the orderly and healthy development of the creator economy Specifically,the legal regulation of creator economy needs to consider both the platform's private entity status and public management role,address the inherent legal risks of platform code and technology,and examine the production factor significance of creators' data from the perspective of "world digitization".
