数字时代网络文学的独创性判断重构

Reconstruction of Originality Judgment Criterion of Network Literature in the Digital Age

网络文学作为数字时代重要的网络文化产品,提供了显著的经济与社会效益。网络文学的“共享”与“去中心化”两个方面的特殊性不仅破除了传统文学创作的门槛,也为文化传播提供了有效途径,但这种特殊性也让本就存在理论缺陷的独创性进一步陷入网络文学的实践适用困境中,最终导致现有的独创性判断标准无法有效应对网络文学现在与未来可能出现的新问题。数字时代背景下,应当引入“合理人原则”并通过“合理公众”与“合理创作者”的建构、网络文学作品的“核心层”与“边缘层”的划分、法官个人认知与信息筛选能力三个阶段,对网络文学作品进行独创性判断,最终完成对数字时代网络文学独创性判断标准的重新构建。

As an important network cultural product in the digital age,network literature provides significant economic and social benefits.The particularity of"sharing"and"decentralisation"of network literature breaks the threshold of traditional literature writing and provides an effective way for cultural communication.However,this particularity also exacerbates the originality,which is already plagued with theoretical defects,plunging it deeper into the quandary of ap⁃plying network literature in practice.Consequently,the existing standard for evaluating originality fails to effectively ad⁃dress the emerging challenges that may arise in the present and future landscape of network literature.In the context of the digital age,the"reasonable person principle"should be introduced.Through the construction of"reasonable pub⁃lic"and"reasonable creator",the division of"core layer"and"periphery layer"of network literature,the judge's per⁃sonal cognition and information filtering ability to judge the originality of network literature in three stages,and ulti⁃mately to complete the re-construction of the originality judgement criterion of network literature in the digital age.
