大学生帮助信息网络犯罪活动罪何以发生?——基于扎根理论的分析

On the Reasons Why the Crime of College Students Helping Information Network Crime is Getting Worse:A Qualitative Research Based on Grounded Theory

大学生帮助信息网络犯罪活动罪愈演愈烈,亟待予以积极有效治理。然而,当前研究缺乏对此现象的系统性解释框架,鉴于此,本文基于内外部驱动力,运用扎根理论质性研究方法,构建犯罪机制的理论模型。研究发现:犯罪机遇的刺激、犯罪特性的刺激、监管机构的疏漏等外界消极变量是大学生犯罪心理形成的外部推力。在外界消极变量、个人需求及个性结构的多重作用下,大学生产生了主导心理与从属心理的激烈冲突,形成了自我保护的心理防御机制,成为驱动犯罪的内在动力。因此,防范化解大学生帮助信息网络犯罪活动罪的关键在于预防大学生犯罪心理产生和限制大学生犯罪心理外化。

The crime of college students helping information network crime is becoming more and more serious,which needs to be actively and effectively governed.So far the research still lacks a systematic explanation framework for this phenomenon.In view of this,based on the internal and external driving force of the crime,and using qualitative research methods of grounded theory to build a theoretical model of crime mechanism,the study finds that the stimulation of criminal opportunities,the stimulation of criminal characteristics,the omis⁃sion of regulatory agencies and other external negative variables are the external thrust of the formation of col⁃lege students'criminal psychology.Under the multiple influences of external negative variables,personal needs and personality structure,college students experience a fierce conflict between dominant psychology and subor⁃dinate psychology,and would form a psychological defense mechanism of self⁃protection,which become the in⁃ternal driving force of committing the crime.Therefore,the key to preventing and resolving the crime of college students helping information network crime is to prevent the generation of college students'criminal psychology and limit the externalization of college students'criminal psychology.
