摘要
我国《民法典》居住权制度由保障权利人居住利益而产生,以满足生活居住需要为规则设立依据,允许当事人以约定的方式对负担居住权的住宅进行出租。然而,实践中产生的出租相关问题使得约定出租权的行使需要进一步界定和明晰。应注意合理界分所有权与居住权的权能范围;明确承租人租赁权的对抗保护规则;在居住权登记中明确出租事项约定,限制住宅出租的约定期限,厘清权利遭受侵害时的救济途径。
The right of habitation system in the Civil Code of the People’s Republic of China is generated by the protection of the residence interests of the right holder and is based on the rule of meeting the needs of habitation and living,allowing the parties to rent the dwelling bearing the right of habitation in an agreed way.However,the lease-related problems arising in practice make the exercise of the agreed lease right be further defined and clear.Suggestions are:paying attention to the reasonable definition of the scope of the right of ownership and the right of habitation;clarifying the antagonistic protection rules of the lessee’s right and the agreement on leasing matters in the registration of the right of habitation,the limitation of the agreement on the duration of the leasing of habitation,and the remedy approach when the rights are infringed.
