公共场所故意驾车撞人行为的定性研究

在以危险方法危害公共安全罪的涉及领域不断扩大,从而引发学界对其将沦为新的“口袋罪”的批判的这一背景下,针对频发的公共场所故意驾车撞人的行为定性出现了争议。其实,对此类行为的定性更应着眼于行为本身,而非为了避免以危险方法危害公共安全罪的“口袋化”就以本不足以充分评价此类行为的故意杀人罪进行认定。通过分析以故意杀人罪认定此类行为的漏洞,来论证以“以危险方法危害公共安全罪”认定此类行为更妥当,进而为完善现行以危险方法危害公共安全罪提供认定标准。

Under the background that the crime of endangering public security by dangerous means is expanding in scope,which leads to the criticism of the academic circle that it will become a new“crime of mouth bag”,there is a dispute over the definition of intentional driving into people in public places frequently.In fact,the qualitative of such behavior should focus more on the behavior itself,rather than to avoid the"pocketing"of the crime of endangering public security in a dangerous way to identify the crime of intentional homicide,which is not enough to fully evaluate such behavior.Through the analysis of the loopholes of identifying such behavior with intentional homicide,it is proved that it is more appropriate to identify such behavior with the crime of endangering public security by dangerous methods,so as to provide the identification standard for improving the current crime of endangering public security by dangerous methods.
