未成年人网络保护的国际经验及其启示

International Experience of the Protection of Minors from the Internet

互联网是当代未成年人学习、娱乐和社交的重要工具,对其日常生活和社会化进程的影响持续增强。网络给人民带来便捷信息和优质内容的同时,在个人健康、家庭关系、价值观养成以及社会交往等方面也存在诸多风险,对未成年人的健康成长造成不可忽视的影响。国际社会针对未成年人网络保护形成了“三大理论流派”一—自我规制派、政府规制派和合作规制派。这些治理机制对我国未成年人网络保护具有一定的参照价值。基于此,倡议我国在保护未成年人网络安全方面加快立法,完善相关法律法规,大力开展技术研发,注重网络素养教育,充分发挥家庭和学校的教育和引导作用。

The Internet is an important learning,entertainment and social tool for contemporary minors,and its influence on their daily life and socialization continues to rise.While the Internet brings convenience and high-quality content,it also brings many risks in terms of personal health,family relationships,value formation,social interaction,etc.The international community has formed"three major theoretical schools"for the protection of minors on the Internet,namely,self-regulation,government regulation and cooperative regulation.Based on this,it is proposed that China accelerate legislation in the protection of minors from the Internet,vigorously carry out technology research and development,pay attention to education on proper use of Internet,and give full play to the education and guidance role of families and schools.
