摘要
随着经济全球化和消费主义思潮的渗透,个人尤其是青少年的消费观念与消费行为受到显著影响。在消费主义思潮下,“偶像经济”将“人格商品化”作为产品核心,提升商品附加价值,但其发展过程中存在诱导过度消费、法规适用范围受限、引导消费者重大误解等现象,侵害偶像追随者群体的消费权益。为破解偶像追随者群体消费权益保护困境,可通过法律解释、法律完善、制度构建等路径,优化以《消费者权益保护法》为主的相关法律法规和“偶像经济”监管制度,规制“偶像经济”的肆意扩张,避免以无限逐利为目标的消费主义对“偶像经济”的侵蚀,引领理性消费,保护偶像追随者合法消费权益。
With the infiltration of economic globalization and consumerism,the consumption concept and behavior of individuals,especially young people,have been significantly affected.Under the trend of consumerism,the"idol economy"takes the"commercialization of personality"as the core of the product to enhance the added value of the product.Nevertheless,in its development process,there are some phenomena such as inducing excessive consumption,limiting the scope of application of laws and regulations,and leading consumers to major misunderstandings,which infringe on the consumer rights of the group of idolaters.In order to solve the dilemma of protecting the consumer rights and interests of idolaters,we can optimize the relevant laws and regulations led by the Law of the People s Republic of China on the Protection of Consumers Rights and Interests and the supervision system of the"idol economy"through legal interpretation,legal improvement,and institutional construction,regulate the wanton expansion of the"idol economy",avoid the erosion of the"idol economy"by the unlimited profit-seeking consumerism,guide rational consumption and protect the legitimate consumption rights and interests of idolaters.
