法律诊所:撬动法学专业教育与职业教育的融合发展 被引量:1

摘要 以法律援助为载体的法律诊所课程是法学专业的重要实践课之一。改革的出发点在于打通专业教育与职业教育之间的壁垒,以律师提供法律服务为改革主线,改善理论教学与职业实务脱节状况,从而解决学生难以接触实务的现实问题。整个教学内容设计是以律师基本技能为中心,按照“一流课程”标准设计教学目标,借助现代化的教学手段采用灵活多变的诊所方法组织教学,由100%“双师型”教师组团授课,打破传统单一评价模式,学生在提供无偿法律援助过程中培养独立解决实际问题的能力、加强法学理论修养、形成批判性法律思维和积极主动的学习态度。 Legal Clinic course with legal aid as carrier is one of the important practical courses for law majors.Its reform aims to break down the barrier between professional education and vocational education,and to reconnect theoretical teaching to professional practice by taking lawyers legal services as the thread running through the reform,thereby solving the real problem that students are hard to carry out professional practice.The teaching content is centered on lawyers basic skills,the teaching objectives benchmark the standard of"first-class courses",the teaching procedures are organized by modern teaching methods and flexible clinic methods,and the teaching team are all"double-qualified"teachers.It breaks the traditional single evaluation model,and in providing free legal aid,students develop the ability to solve practical problems independently,strengthen the master of legal theory,and develop critical legal thinking ability and active learning attitude.
