当前我国学术数据库平台领域垄断问题凸显,依法对该领域进行规制并提出健康可持续发展思路势在必行。以知网为例,从该领域实际出发,结合《国家市场监管总局行政处罚决定书》和行业一手数据资料对学术数据库平台领域反垄断中相关市场的界定、市场支配地位的判定及具体违法行为的分析思路和方法进行探讨。提出依法对知网滥用市场支配地位行为进行科学有效规制、强化学术数据库平台领域竞争合规性审查和反垄断监管、开创学术数据库平台高质量转型发展新思路等化解路径。

At present,the problem of monopoly in the field of academic database platform in China is prominent,so it is imperative to regulate this field according to law and put forward ideas for healthy and sustainable development.A case study of CNKI:from the actual situation of the field,combined with the State Administration for Market Regulation Administrative Punishment Decision and first-hand industry data,the definition of the relevant market in the field of academic database platform anti-monopoly,the judgment of market dominance and the analysis of specific illegal behaviors are discussed.This paper puts forward some solutions,such as scientific and effective regulation of the abuse of dominant market position by CNKI according to law,strengthening competition compliance review and anti-monopoly supervision in the field of academic database platform,and creating new ideas for high-quality transformation and development of academic database platform.
