On The Realistic Dilemma and Response Path of Intellectual Property Governance in the Digital Era

数字时代,不断创新的数字生态对知识产权治理提出了更高要求。文章从数字时代知识产权的治理现状出发,阐释了知识产权治理内容更加复杂、治理法规相对滞后、审查能力相对薄弱与维权动力不足等现实困境,结合系统化、国际化和法典化的知识产权治理观,提出完善法治框架、行政治理、市场化治理、技术治理和社会治理等应对建议。

In the digital age,the constantly innovating digital ecosystem has put forward higher requirements for intellectual property governance.In order to improve the efficiency of intellectual property governance and effectively resolve governance difficulties,this article starts from the current situation of intellectual property governance in the digital age,explains the practical difficulties of more complex intellectual property governance content,relatively lagging governance regulations,relatively weak review capabilities,and insufficient rights protection motivation.Combining with a systematic,international,and codified view of intellectual property governance,it proposes to improve the legal framework,administrative governance,market-oriented governance,technological governance and social governance.
