摘要
数字时代以来,行政机关使用人脸识别技术处理人脸信息以履行其职权,这在赋能行政履职的同时触及了公民身体权、个人信息权,且可能因不当处理致损其他人身权、财产权和平等权,如何对之进行立法规制就尤为重要。所触及权利的基本权利性质,要求具有与之匹配的法形式对行政机关的人脸信息处理活动作出规定。由于法律与行政立法、地方人大立法在民意基础和制定程序上存在差异,宜以狭义法律的形式规范行政机关的人脸信息处理活动。在法的内容上,应为行政机关设定全过程的义务,包括对人脸信息的有限收集、有限使用以及个人参与的保障。
In the digital era,administrative organs have used face recognition technology to process face information to perform their functions and powers.This face information processing behavior not only enables the administrative performance of duties,but also touches on citizens’physical rights,personal information rights,and may cause damage to other personal rights,property rights and equality rights due to inappropriate processing.So how to legislate and regulate the behavior becomes particularly important.The nature of the basic rights of these rights requires a matching legal form to regulate the face information processing activities of administrative organs.Due to the differences between law,administrative legislation and local people's congress legislation in terms of public opinion basis and formulation procedures,it is appropriate to regulate the face information processing activities of administrative organs in the form of laws.In terms of the content of the law,attention should be paid to setting the obligations for the administrative organs in the whole process,guaranteeing limited collection,limited use,and individual participation offace information.
