The legal dilemma and strategies of family trust in China in the new era

家族信托起源于美国内战之后,由于其具有传承性、隐私性等特点,使其成为家族财富传承的一种重要手段,然而我国相关法律对家族信托的规定却相对简单,故此从家族信托的概述入手,着重阐述了家族信托的概念以及家族信托的财富保护以及家族传承功能;我国相关法律法规对家族信托的规定的漏洞;探析我国家族信托在确定所有权和登记制度方面的困境,最后针对我国家族信托在法律法规方面的困境给出家族信托所有权归属受托人、采用登记对抗和登记生效主义相结合登记制度的建议,以此助推家族信托在我国的长远发展。

Family trust originated after the American Civil War.Due to its characteristics of inheritance and privacy,it has become an important means of inheriting family wealth.However,the relevant laws in China have relatively simple provisions for family trust.Therefore,starting from the overview of family trust,this article focuses on the concept of family trust,as well as the wealth protection and family inheritance function of family trust;The loopholes in China's relevant laws and regulations regarding family trusts;Exploring the difficulties in determining ownership and registration system of family trusts in China,and finally providing suggestions for the ownership of family trusts belonging to the trustee,adopting a combination of registration confrontation and registration effectiveness,in response to the legal and regulatory difficulties of family trusts in China,in order to promote the long-term development of family trusts in China.
