摘要
海权作为一个重要的概念,其内涵不断发展和丰富。在此基础上,“交通海权”的概念在海洋开发和利用实践中日益发展。然而,“交通海权”并非西方海洋战略学家视野下海权概念在海洋交通领域的延伸,而是符合当代法律发展、具有独立含义的概念。“交通海权”是指主权国家所拥有的与海上交通事业相关的权利和维护该权利的力量。“交通海权”与海权在所提出的时代背景、内容、目的和相对性方面有区别,两者虽然都包含海洋力量,但海权中的力量侧重于霸权性海洋力量,而“交通海权”中的力量侧重于防卫型海洋力量,其内容包含硬实力和软实力。“交通海权”概念的法治阐释,赋予时代背景下海权以新的内涵和战略意蕴。我国应积极通过以下路径参加北极航道的建设和开发以维护并发展我国“交通海权”:以“冰上丝绸之路”为载体,以人类命运共同体理念为指导;积极参与北极相关国际组织中的规则制定;以我国优势力量为支撑参与北极航道的建设与开发。
As an important concept,the connotation of seapower has been continuously developed and enriched.On this basis,the concept of“traffic seapower”has been germinated and developed in marine development and utilization.However,the“traffic seapower”is not an extension of seapower in the field of maritime transportation under the vision of Western maritime strategists,but a concept that has its own independent meaning and conforms to contemporary legal development.The“traffic seapower”refers to the rights related to maritime transportation and the power to maintain such rights owned by sovereign states.There are differences between the seapower and the“traffic seapower”in terms of the background of the era in which they were proposed,content,purpose,and relativity.Although both seapower and“traffic seapower”include maritime power,the power in seapower focuses on hegemonic maritime power,while the power in the“traffic seapower”focuses on defensive maritime power,and its content includes hard power and soft power.The legal interpretation of the concept of“traffic seapower”endows the sea power with new connotations and strategic implications under the background of the times.China should actively participate in the construction and development of the Arctic waterway to maintain and develop China's“traffic seapower”through the following paths:taking the Polar Silk Road as the carrier and taking the concept of a Community of Shared Future for Mankind as the guide;To actively participate in the formulation of rules in the Arctic-related international organizations;To participate in the construction and development of Arctic waterway with the support of China's superior strength.
