摘要
数字时代为优化裁判文书说理的繁简分流提供了更为便捷的技术条件,针对裁判文书说理繁简分流存在的检索机制不够完善、标准不够明确、程式比较概括或机械等问题,建议在留足个性化说理空间的基础上,从以下方面进一步优化说理繁简分流的路径:一是完善说理繁简分流检索机制,二是设计说理繁简分流的分类模块,三是优化说理结构程式。
The digital era has provided more convenient technological conditions for optimizing the complexity and simplicity of legal reasoning in judicial documents.Addressing issues such as inadequate retrieval mechanisms,unclear standards,and relatively broad or mechanistic procedures in the complexity and simplicity of legal reasoning,it is recommended that,while preserving sufficient space for personalized reasoning,the following aspects be further refined in the path of reasoning complexity and simplicity:firstly,enhance the retrieval mechanism for reasoning complexity and simplicity;secondly,design classification modules for reasoning complexity and simplicity;thirdly,optimize the structural procedures of reasoning.
