平等保护视角下算法歧视的治理进路

The Governance Approach of Algorithmic Discriminationfrom the Perspective of Equal Protection

算法是人工智能时代的基础规则和逻辑架构,人工智能技术对现代社会带来的变革性影响离不开算法对海量数据的自动分析及决策生成。算法技术的中立并不意味着算法价值或决策结果的中立,算法歧视的出现严重挑战社会公平正义理念,威胁个体权利的平等保护,固化社会既有偏见。突破算法歧视的桎梏应当坚持场景化思维,从技术控制和结果控制两个维度出发,紧扣算法和数据两大要素,在参照域外经验的基础上探索出算法治理的中国路径,使算法技术助推国家治理体系和治理能力现代化建设。

Algorithms are the basic rules and logical architecture of the artificial intelligence era.The transformative impact of artificial intelligence on modern society cannot be separated from the automatic analysis and decision-making of massive data by algorithms.The neutrality of algorithmic technology does not mean the neutrality of algorithmic values and decision-making results.The emergence of algorithmic discrimination seriously challenges the concept of social equity and justice,threatens equal protection of individual rights,and solidifies existing prejudices in society.To break through the shackles of algorithmic discrimination,we should adhere to the scenario-based thinking,start from two dimensions of technical control and result control,closely related to the two major elements of data and algorithm,and explore the Chinese path of algorithm governance based on external experience,so as to make algorithm technology boost the modernization of national governance system and governance capacity.
