大数据时代背景下数据安全法治问题研究

Research on the Rule of Law of Data Security in the Era of Big Data

信息技术的发展使数据成为连接网络空间与现实世界的核心要素。数据安全关乎社会稳定与国家安全,是大数据时代面临的综合性全新挑战。法治是国家治理现代化转型的重要路径和手段。数据安全需通过法治化路径实现治理目标,在大数据时代背景下需要重新梳理治理的法治基础与价值定位,分析面临的法治问题与困境,从治理的目标、主体、对象及手段等范畴进行全方位法治反思。在明确数据安全法治框架构建理念与向度前提下,可以从去中心化与再中心化的元治理体系建构、法治引领与平台协同的软硬结合治理手段、算法决策与代码规制的法律应对等重点环节,有效架构“多元开放性、多维立体化”的数据安全法治框架,进而推动我国数据安全治理的法治化转型。

The development of information technology has made data a central element in connecting cyberspace with the real world.Data security is related to social stability and national security,and is a comprehensive new challenge in the era of big data.The rule of law is an important path and means for the modernization of national governance.Data security needs to achieve governance goals through the path of rule of law.In the era of big data,it is necessary to re-sort out the rule of law foundation and value orientation of governance,analyze the problems and dilemmas faced by the rule of law,and conduct a comprehensive reflection on the rule of law from the fields of governance goals,subjects,objects and means.On the premise of clearly defining the concept and direction of the construction of the data security legal framework,we can effectively construct a"pluralistic,open and multidimensional"data security legal framework from key aspects such as the construction of decentralized and decentralized meta-governance system,the combination of soft and hard governance means of rule of law guidance and platform coordination,and the legal response of algorithmic decision-making and code regulation.And then the transformation of the rule of law of data security governance will be promoted in our country.
