风险社会语境下的生态环境治理——以企业合规为视角

Ecological Environment Governance in the Context of Risk Society:A Perspective of Corporate Compliance

随着国家在生态环境治理方面的持续发力,我国生态环境治理工作取得了积极效果,但是在风险社会语境下,环境污染事故总量仍呈扩大化趋势。生态环境治理手段失灵的原因包括地方保护主义、外部监管的局限性、环境污染事故损害加剧以及司法实践中责任划分混乱等问题。因此有必要通过引入企业生态环境合规制度,击穿行政罚——刑罚二元处罚机制,构建国家——企业二元管理机制加以解决。在生态环境合规的制度设计上要充分考虑中小微民营企业的经营状况,同时把握住生态环境治理的新特点,跳出法学视野的限制,通过引入生态环境二元补偿机制以及绿色金融手段,构建出更具现实生命力的中国特色生态环境合规制度。

With the continuous efforts in ecological environment governance,China's ecological environment governance has achieved positive results.However,in the context of a risk society,although the number of environmental pollution accidents has decreased,the total amount of accident damage is still expanding.The reasons for the failure of ecological environment governance measures include local protectionism,limitations of external regulation,intensified damage caused by environmental pollution accidents,and confusion in the division of responsibilities in judicial practice.Therefore,it is necessary to introduce the enterprise ecological environment compliance system,break down the dual penalty mechanism of administrative penalty and penalty,and build the dual management mechanism of state-enterprise to solve the problem.In the system design of ecological environment compliance,we should fully consider the operating conditions of small,medium-sized and micro private enterprises,grasp the new characteristics of ecological environment governance,get rid of the limitation of legal vision,and build a more realistic ecological environment compliance system with Chinese characteristics by introducing the ecological environment dual compensation mechanism and green finance means.
